1. Scope & Consent

The KAZKA mobile messaging service (the “Service”) enables the receipt of recurring SMS/text messages about offers, promotions, and reminders (e.g., cart reminders). By using the Service and/or consenting to receive SMS, you agree to these Mobile Terms of Use (“Mobile T&Cs”).

Participation is voluntary and not a condition for purchase. We may change or discontinue the Service and its features at any time. Changes to these Mobile T&Cs apply upon publication; continued use constitutes your consent.

2. Consent & Legal Basis

By consenting, you will receive recurring SMS to the mobile number you provide, possibly using an automated dialing system or similar technology. The legal basis is Art. 6(1)(a) GDPR (consent). You may revoke your consent at any time (see section 4).

3. Costs & Frequency

We do not charge fees. However, message and data rates may apply depending on your mobile provider’s tariff. Message frequency varies.

4. Unsubscription (Opt-out)

You can unsubscribe at any time by sending the keyword STOP in reply to one of our messages or (if available) by using the unsubscribe link in the SMS. You will receive a one-time confirmation message and no further marketing SMS from us unless you initiate them again.

If you have subscribed to multiple KAZKA SMS programs, you must unsubscribe separately from each – as far as legally permissible.

6. Number Change

You agree to inform us of any change to your mobile number. Please re-register with a new number.

7. Network Operators & Delivery

The mobile operators involved in the Service are not liable for delayed or undelivered messages. Delivery may depend on network conditions.

8. Data Protection

We respect your privacy. Information on the processing of personal data, including the use of cookies/plugins to detect abandoned carts for SMS reminders, can be found in our Privacy Policy. This includes, among other things:

• We use cookies/similar technologies to detect when a cart has been abandoned and may send SMS reminders accordingly.
• Excluded: The sharing or sale of opt-in data and SMS consents to unrelated third parties does not occur.

9. Disclaimer

To the extent permitted by law, we are not liable for failed, delayed, or misdirected deliveries of information via the Service, for errors in this information, or for actions taken or omitted based on the information.

10. Changes to Short Codes/Senders

We may change the short codes or sender IDs we use at any time and will inform you accordingly. Messages sent to a replaced number (including STOP/HELP) may not reach us.

11. Applicable Law

German law applies. Mandatory consumer protection regulations of your habitual residence remain unaffected.
